Please read these terms carefully before using KasiCart platform
IMPORTANT NOTICE
By accessing or using the KasiCart platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our platform.
Definitions
Refers to the digital marketplace, mobile applications, websites, and all associated services provided by KasiCart (Pty) Ltd, including but not limited to KasiLink delivery services.
Any individual or entity that uses the KasiCart platform to purchase goods, book services, rent items, or utilize delivery services.
Any individual or informal business entity registered on KasiCart to sell physical goods, offer services, rent items, or provide skills. Includes both "Sellers" (physical goods) and "Service Providers" (services/skills).
An independent contractor registered with KasiLink to provide delivery, collection, and moving services using their own vehicle.
The monthly fee of R29.99 payable by Traders for platform access. Service Providers and Sellers each require separate subscriptions (R59.98 for both).
Individuals or micro-businesses operating without formal business registration, typically from homes, streets, or temporary locations.
Any information, text, images, videos, reviews, or other materials posted on the platform by Users.
Platform Overview
KasiCart is a multi-service marketplace platform that enables:
- Traditional e-commerce (physical goods sales)
- Services and skills economy (haircuts, plumbing, tutoring, etc.)
- Rental economy (tools, equipment, vehicles)
- Delivery and logistics (KasiLink network)
- Gig economy and quick tasks
- Digital services and freelance work
The platform operates under South African law and is designed specifically for the informal economy.
Consumer Responsibilities
Account Registration
Consumers must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.
Purchasing Goods
When purchasing goods:
- You agree to pay the listed price plus any applicable delivery fees
- Transactions are between you and the Trader
- KasiCart is not a party to the sale
- You must verify product details before purchasing
Booking Services
When booking services:
- Provide accurate information about the service required
- Be available at the agreed time and location
- Pay the agreed amount directly to the Service Provider
- Report any issues within 24 hours of service completion
Dispute Resolution
If you have a dispute with a Trader:
- First attempt to resolve directly with the Trader
- If unresolved, contact KasiCart Support within 7 days
- Provide evidence of the transaction and issue
- KasiCart will mediate but cannot guarantee resolution
Prohibited Actions
Consumers must not:
- Harass or threaten Traders or Delivery Partners
- Attempt to transact outside the KasiCart platform
- Leave false or malicious reviews
- Use the platform for illegal purposes
- Share account access with others
Consumer Rights
Right to Information
You have the right to accurate information about goods and services, including pricing, specifications, and Trader details.
Right to Safety
You have the right to expect that services will be performed safely and professionally. Report any safety concerns immediately.
Right to Privacy
Your personal information will be protected according to our Privacy Policy and POPIA regulations.
Right to Redress
You may report unsatisfactory goods or services through our dispute resolution process.
Trader Responsibilities
Registration Requirements
Traders must:
- Provide valid South African ID number
- Submit accurate contact information
- Verify phone number and email address
- Agree to monthly subscription terms
- Maintain active subscription for platform access
Subscription Terms
- R29.99/month for Seller OR Service Provider access
- R59.98/month for combined Seller AND Service Provider access
- Monthly auto-renewal unless cancelled
- No commissions on sales or service fees
- 24-hour notice required for cancellation
Product Listings
Traders must ensure:
- Accurate descriptions and clear photos
- Honest representation of condition and quality
- Compliance with South African law (no illegal items)
- Timely updating of availability and pricing
Service Offerings
Service Providers must:
- Clearly define service scope and limitations
- Provide qualifications or experience where relevant
- Maintain professional conduct
- Carry necessary tools and materials
- Honor agreed appointment times
Pricing and Payments
- Set fair and competitive prices
- Include all costs in quoted prices
- Accept payment methods offered on platform
- Issue receipts for all transactions
- Keep transaction records for 5 years
Tax Responsibilities
Traders are responsible for:
- Registering for tax if required by SARS
- Keeping accurate financial records
- Paying applicable taxes on income
- Complying with VAT regulations if applicable
Prohibited Items & Services
Absolutely Prohibited:
- Illegal drugs or substances
- Stolen goods
- Weapons or firearms
- Pornographic material
- Counterfeit goods
- Hate speech or discriminatory services
Restricted (Require Approval):
- Alcohol sales (requires license verification)
- Tobacco products
- Certain health supplements
- Financial services
- Animal sales
KasiLink Delivery Terms
Delivery Partner Requirements
KasiLink Drivers must:
- Possess valid South African driver's license
- Maintain roadworthy vehicle with current license
- Have valid vehicle insurance
- Pass background check
- Complete KasiLink orientation
Independent Contractor Status
Delivery Partners are independent contractors, not employees. You are responsible for:
- Your own tax obligations
- Vehicle maintenance and fuel
- Insurance premiums
- Operating hours and schedule
Delivery Fees and Payments
- Set your own delivery rates within platform guidelines
- Receive 100% of delivery fees (no commission)
- Weekly payouts to registered bank account
- Minimum delivery fee: R25 within 5km radius
Collection Services
When collecting items from other platforms:
- Verify collection details with Consumer
- Confirm collection point operating hours
- Obtain proof of collection
- Deliver promptly to Consumer
Liability and Insurance
- You are liable for goods in your possession
- Must report damages or losses immediately
- Recommended minimum R50,000 goods-in-transit insurance
- KasiCart is not liable for delivery disputes
Code of Conduct
Delivery Partners must:
- Maintain professional appearance
- Be punctual for collections and deliveries
- Handle packages with care
- Respect Consumer privacy and property
- Report safety concerns immediately
General Terms & Conditions
Acceptance of Terms
By using KasiCart, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations.
Modification of Terms
KasiCart reserves the right to modify these terms at any time. Continued use after changes constitutes acceptance. Users will be notified of significant changes.
Platform Availability
We strive for 24/7 availability but do not guarantee uninterrupted service. We may suspend access for maintenance, upgrades, or security reasons.
Intellectual Property
All platform content, trademarks, and logos are property of KasiCart (Pty) Ltd. Users retain ownership of their content but grant KasiCart license to display it.
Limitation of Liability
KasiCart is not liable for:
- Transactions between Users
- Quality of goods or services
- Delivery delays or issues
- User conduct or disputes
- Technical issues beyond our control
Dispute Resolution
All disputes shall first attempt mediation through KasiCart. Unresolved disputes may be referred to appropriate South African courts.
Governing Law
These terms are governed by South African law, specifically:
- Consumer Protection Act 68 of 2008
- Protection of Personal Information Act 4 of 2013
- Electronic Communications and Transactions Act 25 of 2002
- National Credit Act 34 of 2005 (where applicable)
Termination
KasiCart may suspend or terminate accounts for:
- Violation of these terms
- Illegal activity
- Fraudulent behavior
- Non-payment of subscription fees
- Harm to other Users
